Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and ListOptimise ("we," "our," or "us"), the operator of the website at listoptimise.online. By creating an account, accessing, or using ListOptimise, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you may not use the service. You must be at least 13 years old (or the minimum age of digital consent in your country) to use ListOptimise. If you use the service on behalf of a business, you represent that you are authorized to accept these Terms on its behalf.

ListOptimise is an AI-powered toolkit that helps Etsy and Shopify sellers create and improve their listings and shop content. The service includes tools to:

• Generate optimized product titles, descriptions, tags, and image alt text
• Generate social and shop content (announcements, captions, messages, about sections)
• Audit existing listings and receive a score with improvement suggestions
• Research Etsy search keywords and run a full shop audit
• Analyze customer reviews for themes and insights
• Generate listings in bulk (Pro)
• Track whether AI assistants recommend your shop (AI Visibility Checker, Pro)
• Ask our on-site assistant questions about the product
• Use the free Etsy Fee Calculator

ListOptimise is an independent product. We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. or Shopify Inc. "Etsy" and "Shopify" are trademarks of their respective owners and are referenced only to describe compatibility. You are responsible for ensuring your use of generated content complies with the rules and policies of any marketplace where you publish it.

To use most features you must create an account with a valid email address. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at hello@listoptimise.online if you suspect unauthorized use. You must provide accurate information and may not impersonate another person or create an account on someone else's behalf without permission.

ListOptimise offers a Free plan and a paid Pro plan.

• Free plan: Includes a limited number of AI generations per month (currently 10 generations/month), plus daily limits on the Listing Checker and Reviews Analyzer. The free Fee Calculator is available to everyone without an account.
• Pro plan: Costs $9 per month and unlocks unlimited generations, unlimited listing checks and review analyses, bulk generation, multi-language output, full history, and priority support.

Free trial: New accounts may receive a 7-day trial of Pro features. No payment method is required. When the trial ends, the account moves to the Free plan automatically — you are not charged, and there is nothing to cancel. One trial per account.

Plan limits, included features, and pricing may change over time. Where required, we will give existing subscribers reasonable notice of any price change before it takes effect. Monthly generation limits reset on the first day of each calendar month; the per-day limits on the AI analysis tools reset daily. The limits shown on our Pricing page are current at the time of publication and control over any figure quoted here.

• Recurring billing: The Pro plan is billed monthly in advance. By subscribing, you authorize us and Lemon Squeezy to charge your payment method $9 each month until you cancel.
• Cancellation: You may cancel at any time. Your Pro features remain active until the end of the current billing period, after which your account reverts to the Free plan. We do not delete your saved history when you downgrade.
• Refunds: We do not offer a money-back guarantee. Except where required by applicable law (including any statutory withdrawal right you may have as a consumer), monthly payments are non-refundable. Cancelling stops future charges; it does not refund the period already paid for. The Free plan and the 7-day Pro trial both let you evaluate every tool at no cost and without a card before you pay anything.
• Taxes: Prices are shown exclusive of any applicable taxes, which may be added at checkout by the Merchant of Record.

You agree not to use ListOptimise to:

• Generate content that is unlawful, infringing, defamatory, hateful, harassing, or sexually exploitative
• Create listings for counterfeit, stolen, illegal, or prohibited goods, or to make false or misleading product claims
• Violate the terms or policies of Etsy, Shopify, or any other platform where you publish generated content
• Infringe the intellectual property, privacy, or other rights of any third party
• Reverse engineer, scrape, resell, or build a competing service from the product or its outputs
• Attempt to bypass usage limits, access other users' data, or interfere with the security or operation of the service
• Submit other people's personal information without a lawful basis to do so

We may suspend or terminate accounts that violate these Terms, with or without notice where appropriate.

Your inputs. You retain ownership of the product details, listing text, reviews, and other content you submit ("Inputs"). You grant us a limited license to process your Inputs solely to operate the service — including sending them to our AI providers (Groq and Anthropic) to produce output.

Your outputs. As between you and us, you own the content the service generates for you from your Inputs ("Outputs"), and you are free to edit, publish, and use it for your shop.

AI disclaimer. Outputs are generated by automated AI models and are provided "as is." They may be inaccurate, generic, incomplete, or similar to content generated for other users. We do not guarantee that Outputs are original, non-infringing, factually correct, or that they will improve your search ranking, traffic, or sales. You are solely responsible for reviewing, editing, and verifying any Output before you publish or rely on it, including ensuring it is accurate, complies with applicable laws and marketplace policies, and does not infringe third-party rights.

We aim to keep ListOptimise available and reliable, but the service is provided on an "as available" basis. We may modify, suspend, or discontinue any feature at any time, and the service depends on third parties (such as Supabase, Groq, Anthropic, and Vercel) whose availability is outside our control. We are not liable for interruptions, delays, or data loss caused by those providers or by scheduled maintenance.

To the fullest extent permitted by law, ListOptimise is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any result obtained from it will meet your expectations.

To the fullest extent permitted by law, ListOptimise and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, sales, data, or goodwill, arising out of or related to your use of (or inability to use) the service or any Output — even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless ListOptimise and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Inputs, your Outputs, your use of the service, or your violation of these Terms or of any third-party rights or marketplace policies.

You may stop using the service and delete your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination, your right to use the service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of ListOptimise after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the service.

These Terms are governed by the laws of the country in which ListOptimise's operator is established, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the competent courts of that location, except where applicable consumer-protection law gives you the right to bring proceedings in your own country of residence. Nothing in these Terms limits any mandatory statutory rights you have as a consumer.
